These Terms of Use ("the Terms") govern your access to and use of Vibe Coder ("the Service"), operated by its provider ("we", "us", or "the Provider"). By creating an account, logging in, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not register or use the Service. You also confirm that you are legally capable of entering into this agreement.
You must be at least 18 years old and legally able to enter into a binding contract. By registering, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
The Service uses artificial-intelligence models to generate code, text, and other content in response to your prompts, and to help you build, run, and deploy applications. AI-generated output may be incorrect, incomplete, biased, insecure, or otherwise unsuitable. You must independently review and test everything the Service produces before relying on or publishing it. The Service is a tool to assist you; it does not replace professional judgment, human review, or quality assurance.
You are solely and fully responsible for everything you create, generate, build, deploy, publish, or distribute using the Service — including any code, applications, files, integrations, content, and data — and for all consequences of using or deploying them. This includes responsibility for security vulnerabilities, data handling, legal compliance, licensing, intellectual property, and any harm or costs caused to any third party. The Provider does not own, endorse, warrant, or take responsibility for anything you build with the Service.
The Service is provided strictly "as is" and "as available", with all faults. To the maximum extent permitted by law, the Provider disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or produce accurate or usable output. No advice or information obtained from the Service constitutes legal, financial, or professional advice.
To the maximum extent permitted by applicable law, in no event shall the Provider, its operators, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, business, or goodwill, arising out of or related to your use of, or inability to use, the Service — whether based on warranty, contract, tort, or any other legal theory, and whether or not the Provider was advised of the possibility of such damages. The Provider's total liability for any claim arising from the Service shall not exceed the amount, if any, you paid to the Provider for the Service in the three months preceding the event giving rise to the claim.
All payments are final and non-refundable. Credits, subscriptions, one-time purchases, and any other fees paid for the Service are not refundable for any reason, including account suspension, termination, cancellation, unused balances, dissatisfaction, or service interruptions. Unused credits and remaining subscription time expire without refund. The Provider may change pricing, credit grants, and subscription terms at any time; changes take effect for future purchases only.
The Service measures usage in credits. Each action you take (such as a chat turn, build, or deploy) consumes credits. The Provider determines credit costs and may change them at any time. New accounts may receive a one-time promotional credit grant that carries no monetary value, is non-transferable, and may expire. The Provider may adjust, revoke, or modify promotional credits at its discretion.
You are responsible for keeping your username, password, and account access secure and confidential, and for all activity under your account. Notify the Provider immediately of any unauthorized use or security breach. The Provider is not liable for any loss from unauthorized account access. Accounts may be suspended, restricted, or terminated at the Provider's sole discretion, including for violation of these Terms or for any other reason.
You will not use the Service to: build or distribute malware, spyware, or anything harmful or malicious; infringe any intellectual-property or privacy right; generate unlawful, defamatory, harassing, or abusive content; attempt to gain unauthorized access to any system, data, or account; disrupt, overload, or reverse-engineer the Service; or violate any applicable law. The Provider may remove content, revoke access, and report violations to authorities.
The Service may connect to or generate code that interacts with third-party services (such as payment processors, email providers, cloud platforms, AI providers, and deployment targets). You are solely responsible for complying with those third parties' terms and for any fees, data, or liability arising from your use of them. The Provider is not a party to those relationships and is not responsible for their availability, accuracy, or conduct. Your use of any third-party AI model is subject to that provider's policies; the Provider does not guarantee the availability, quality, or naming of any particular model.
You are responsible for any data, prompts, files, or content you upload or submit to the Service, and for having the rights to do so. The Provider may process, store, and transmit your content to provide the Service, including passing it to third-party AI providers. You should not submit confidential, sensitive, or regulated personal data unless you accept that risk. The Provider is not responsible for the confidentiality of data you choose to submit.
You agree to indemnify and hold harmless the Provider, its operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of any third party — including anything you build, deploy, or distribute using the Service.
The Provider may revise these Terms at any time. The version in force is identified by the date and version shown at the bottom of this page. When you register, the specific version you accepted is recorded with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to revised Terms, your sole remedy is to stop using the Service.
The Provider may suspend or terminate your access at any time, for any reason, without notice or liability. Upon termination, all licenses granted to you end immediately. Sections that by their nature should survive termination — including the no-refund, no-warranty, limitation-of-liability, and indemnification clauses — remain in effect.
These Terms are governed by the laws of the Provider's jurisdiction, without regard to conflict-of-laws rules. If any provision is found unenforceable, the rest remain in effect. The Provider's failure to enforce any right is not a waiver. These Terms constitute the entire agreement between you and the Provider regarding the Service.
